Bail, Plea & Hold Until Trial
Bail Process (Not Guilty plea only)
1. Pay Bail → released.
2. Sent to Bolingbroke Penitentiary if can't/won't pay or ineligible for ankle monitor — serves recommended time, no fine. If later found not guilty: awarded $250/month spent in Bolingbroke.
Time reduction: up to 50% if LEO interrogated the suspect (officer's discretion). Fine reduction: up to 100% for first-time offenders (officer's discretion).
Plea Process
Guilty: sent to Bolingbroke or pay bail at 4x the fine to be released.
Not Guilty: sent to Bolingbroke for 100% of recommended time+fine, unless acquitted (then $250/mo award). Or dispute charges (see HUT box).
Bail Approval / Denial
Approval: runs through LEO Depts and/or the DA's Office. No judge signature needed.
Denial if defendant: is charged w/ any HUT offense; already out on bail for a separate pending matter; charged w/ 2nd Degree Murder of a Gov't Employee, Attempted Mass Murder of a Gov't Employee, Attempted 1st Degree Murder, Attempted Murder of a Gov't Employee, Manslaughter, Felony Battery vs LEO, or Mass Felony Battery vs LEO; or deemed a substantial risk to public/witness safety or judicial integrity (e.g. flight risk).
Hold Until Trial (HUT)
All HUT charges get a 500-month sentence for the crime plus whatever the judge adds after court. Explicit HUT charges: P.C. 1027 (Terrorism), P.C. 3001 (Felony Embezzlement), P.C. 5001 (Corruption).
Once you plead Not Guilty: check DOJ emails for a notice. If none, join DOJ emails and submit a "Dispute Charges" ticket with: full name, whether you have an attorney, whether you need one appointed/referred. Must be done within 7 days of arrest/charges. A judge can then schedule a bench trial and help secure an attorney. You have 1 week (7 days) to dispute charges.
Bail Rights & Forfeitures (read to defendant)
1. New arrest while on bail = automatic forfeiture + sent to Bolingbroke for original + new charges, no bail option on new charges.
2. Right to turn yourself in / plead guilty to await trial anytime.
3. Fail to appear/respond within 7 days ⇒ Warrant + bail forfeited.
4. Court scheduling is the defendant's responsibility, not DOJ/LEO.
Failure to Appear / Dispute Charges
Warrant issued + bail forfeited if paid. Not Guilty plea becomes Guilty upon apprehension. A new incident is filed for Failure to Appear — no bail option.
Payment & Proof
Payment goes defendant → processing party → submitted to Court. Processing party must photo-document receipt from defendant and payment to Court. Bail submission form: Suspect Name – Bail Amount – 1st/2nd/3rd+ Offender.
Return vs. Revoke of Bail
Returned if: defendant arrives to court date; turns self in to change plea/serve time; DA drops charges.
Revoked if: fails to respond to docket within 7 days of posting (⇒ warrant); fails to appear in court (⇒ warrant).

Case Law
Terry v. Ohio
Police may stop w/ reasonable suspicion a crime occurred/is about to; may frisk for weapons w/ reasonable suspicion the suspect is armed & dangerous.
Pennsylvania v. Mimms
Ordering a driver out of the car after a traffic stop + pat-down for weapons does not violate the 4th Amendment.
Maryland v. Wilson
Reasonable for officers to order passengers out of a lawfully stopped vehicle.
Brendlin v. California
All occupants of a car are "seized" for 4th Amendment purposes during a traffic stop, not just the driver.
Arizona v. Johnson
All occupants (not just driver) are detained during a stop and can be questioned about it; extends Mimms to all occupants.
Tennessee v. Garner
Deadly force vs. a fleeing unarmed suspect only allowed if officer has probable cause the suspect poses a significant threat of death/serious injury.
Chimel v. California
Arresting officers cannot search the whole home w/o a warrant, but may search the area within the arrestee's immediate reach.
Minnesota v. Dickerson
4th Amendment permits seizure of contraband felt via touch during a protective frisk ("plain feel").
Illinois v. Wardlow
Nervous, evasive behavior (fleeing a high-crime area at sight of police) is a valid factor for reasonable suspicion.
Graham v. Connor
Objective reasonableness standard applies to claims of excessive force during arrest/stop/seizure.
Florida v. J.L.
An anonymous tip describing only location/appearance (no illegal conduct info) is not enough for stop-and-frisk.
Maryland v. King
Cheek-swab DNA collection upon arrest for a serious offense is a legitimate booking procedure, reasonable under 4th Amendment.

City of West Covina v. Perkins
Due process requires notice that property was seized during a criminal investigation, but not detailed notice of post-seizure remedies.
Spontaneous Utterance
Unprompted statements made under intense emotional duress (before Miranda) can be used — must be unprompted, no police questioning.

DOJ Procedural Manual
Criminal Procedure
- Defendant discusses case w/ attorney/PD; if pleading not guilty, attorney or defendant disputes charges in correct channel.
- DOJ member concurs → complaint filed to demand bench trial → Judge accepts/denies.
- If accepted: case added, service of process via e-mail.
- Defense may file a response w/ prayers to the court; trial date agreed by all parties.
- Discovery phase: prosecution files all evidence/witnesses. Filings are public record unless sealed.
- Sealed filings must be shared with defense counsel (or an attorney appointed if pro-se).
- Trial occurs → witness impact statement + verdict delivered, or continuance motioned.
- Transcript/video filed, case closed. Judge writes a rationale usable as future case law.
Civil Procedure
- Plaintiff pays court fee, files complaint → Judge accepts/denies.
- Non-moving party notified, may respond w/ motions/counterclaims.
- Discovery: both parties file evidence/witnesses. Sealed info follows same rule as criminal.
- Absent a successful pre-trial motion, trial occurs on a preponderance of the evidence standard.
Judges
- Final authority.
- May not engage in corruption or preside if not impartial.
- May not move sua sponte — cannot effectively help either side.
- Verdicts written with rationale — becomes case law.
- May not nullify laws (can impact interpretation).
- Cannot apply constitution/law in a way that breaks core game mechanics (e.g. 2nd Amendment re: firearms).
- Appeals granted only in very limited circumstances.
- Contempt of Court can be charged as misdemeanor or felony at court's discretion.
Attorneys
- Must have passed the Bar to act as attorney.
- Cannot represent a client presenting a conflict of interest.
- Must be of good moral character.
- DOJ may require attorney to act as PD or prosecutor; must disclose conflicts.
- Vexatious/meritless cases can lead to suspension/removal of Bar License.
Pro-Se Defendants
- May self-represent, but opposing side may motion for appointed counsel; judge decides.
- May bring 1 accompanying individual to confer with — only defendant may address the court.
- May obtain counsel anytime, subject to judge's approval, esp. mid-trial.
- May fire representation anytime; opposing party may object, judge rules.
Legal Filings
- All pleadings after initial plea go on a pleading document.
- Pleadings not refused for minor formatting issues.
- Follow movement + response formula, with a response deadline (can motion to set aside).
- Amicus curiae briefing requires the filer to have passed the Bar Exam.
- No home/business address? Use the DOJ's address on filings.
Out-of-Court Settlement
- Parties may settle regardless of criminal or civil.
- File motion to dismiss w/ settlement terms; opposing party may oppose.
- Civil cases may dismiss with/without prejudice. All criminal dismissals are with prejudice — overturned only via mistrial for significant new evidence. Civil w/-prejudice dismissals are not eligible for that treatment.
Witness Questioning & Testimony
- Sworn depositions or (preferably) trial testimony.
- Re-cross examination not currently allowed; witness recall may be requested.
- Proven lying under oath has serious consequences.
- "Pleading the 5th" strikes ALL prior testimony from the record.
- Testimony weighted by position — e.g. biased eyewitnesses weigh less than an unrelated LEO.
Case Law Weight
- US Supreme Court case law: treated with deference.
- State-level case law: usable, court has discretion to disregard.
- Prior San Andreas case law: usually holds, but a judge may overturn/limit w/ strong rationale.
Fruit of the Poisonous Tree
- Evidence must be collected properly and legally in criminal cases.
- All evidence stemming from one illegal act is discarded at trial.
- Civil trials get looser discretion — even evidence ruled inadmissible in a criminal trial may be allowed.
- Challenged-evidence rulings typically happen pre-trial.
Discovery / Subpoenas
- Subpoena duces tecum = production of evidence. Subpoena ad testificandum = production of witnesses.
- Must comply — failure risks a motion to show cause, then possible Contempt of Court.
- Subpoena must be court-approved; serving unapproved = possible Felony Fraud and/or Contempt.
Deadlines
- Criminal trial: file immediately if possible; otherwise 7 days after serving time to file for expungement/restitution.
- Civil trial: file within 14 days of the incident (resets if arising from a pending criminal trial).
- Missed deadlines may be excused for legitimate OOC reasons — discretionary, not a right.
Contracts, IA, and Courtroom Conduct
Contracts: illegal contracts (e.g. assassination) unenforceable, may be handed to LEO as evidence. Must have offer, acceptance, consideration, legal form/content, intent to create legal relations. Any attorney/judge may notarize (may charge a fee).
IA vs. Law: the legal system does not replace Internal Affairs, but you may not pursue restitution through both simultaneously — doing so risks dismissal/summary judgment.
Courtroom: Court = greenzone (no offensive weapons unless on-duty LEO). No RP'ing non-scripted items (e.g. pickaxe) as weapons, or converting non-offensive items (snowballs) into weapons. You may threaten/intimidate witnesses (clearly tied to the case) but never target a judge or opposing counsel.

- Must inform SASBA ASAP upon receiving any misdemeanor/felony charge.
- SASBA has discretion whether you may keep practicing during contested charges.
