The Justice Process ARREST → RESOLUTION

  • 1. Arrest — taken into custody for a suspected violation.
  • 2. Transport & Booking — processed and booked at the station.
  • 3. Arraignment — brought before a Judge; charges and rights explained.
  • 4. Options at arraignment (Not Guilty plea) — three paths: Immediate Bench Trial (judge available — same-day trial and verdict) · Public Defender Representation (if available — same day or short notice) · Standard Docket Process (official notice; 3 days to secure counsel; discovery begins immediately; case placed on the docket).
  • 5. After 3 days (standard docket) — with an attorney the case continues to motions and trial; without one, proceed pro se or ask the Court for assistance if a lawyer is available.
  • 6. Resolution — Not Guilty (free to go) · Guilty (sentence/penalties) · Other (reduced, dismissed, or resolved by agreement).

A&E = Association & Employee. Attorney & Paralegal fees split evenly. Marriages include one DOJ-exempt name change (a second is done pro-bono). All fees due in full before services; non-refundable. Clients see a self-file vs. firm comparison in their portal.

Know Your Rights JUDGE KINGSTON WORKSHOP

The four lines to memorize:

  1. "Officer, am I being detained, or am I free to go?"
  2. "Officer, I do not consent to a search."
  3. "I am invoking my right to remain silent."
  4. "I want a lawyer."
  • Traffic stop: hands visible; provide ID if lawfully stopped; don't fill silence — explaining becomes statements; ask if detained or free to go; if free, thank them and leave; if detained, ask the reason.
  • Searches: "I do not consent to a search." If they search anyway: "I do not consent. I will address it in court." If they claim a warrant: "May I see the warrant?" — check the address and scope, then step back. Cooperate physically without giving up rights legally.
  • If arrested: two sentences, then silence — "I am invoking my right to remain silent." / "I want a lawyer." No "but…", no explaining.
  • Reminders: passengers can ask "detained or free to go?" and stay quiet unless asked; don't fight a frisk — challenge it later; for injuries say "I need medical attention" and ask for EMS. Reach out in DOJ emails for attorney assistance.
